General Conditions


Preamble
These general conditions of sale are agreed between Morgan’s Nature Walks Unipessoal Lda, fiscal identification number 514 269 936, with headquarters in Nave do Barão PO box 405 S, Nave do Barão, 8100-188 Salir and contact +351 969 566 131 (calls to national mobile network), that is therefore designated the Company and the people who wish to make purchases through the website www.mnatwalks.com designated as User.
The parts agree that all purchases made through the website www.mnatwalks.com will be regulated through the present contract with the exception of any conditions previously available on the website.

Article 1 – Objective
  • The present general conditions of sale have as an objective to present and define all the necessary information for the User concerning the methods of orders, sales, payments and render of services or delivery of the purchases performed on the website www.mnatwalks.com.
  • These conditions regulate all the necessary stages to fulfil and order and guarantee the procedure of this order/rendering of services between Contracting Parties.
Article 2 – Reservation for activities
  • The User fulfils the contracting of an activity through the conclusion of the purchase process presented on the website www.mnatwalks.com, adding the intended contracting service of an activity to the shopping basket:
  • To complete the contracting of an activity the User should.
    - Register on the website www.mnatwalks.com by supplying the requested information;
    - Complete the information and choose the options available throughout the process to complete the contracting of services (method of payment, as well a Fiscal Identification Number, the name that for fiscal effects should be on the receipt).
  • The reservation of an activity is only confirmed by the User with the payment of the total price of the activity.
  • With the reservation the User:
    - Confirms to have been informed and accepts the present general conditions of participation as well as the specific conditions relative to the selected activity;
    - Confirms to be of adequate health for the chosen activity and accepts the possibility to take all the risks inherent to its nature;
    - Confirms to be aware of the type of physical demands these activities imply and that there can occur unpredictable events.
  • The Company will honour the reservations received online according to the availability of the activity; the Company commits to inform the User as soon as possible.
  • The information present in the receipt is of the full responsibility of the User. The receipt once immitted cannot be re-immitted again with alterations.
  • The receipt will on be immitted when the payment is finalised to the email provided by the User on the act of registration in the website www.mnatwalks.com.
  • Transportation can be made available if the User requests it. The transportation will have an extra cost (from 140 euros depending on the guided tour) to the activity paid at the time of the reservation. If the User does not require transportation but requires instructions to reach the location of the activity GPS coordinates will be sent to the email provided by the User once the reservation is finalised.
  • The activities have a limited number of participants.
Article 3 – Orders
  • The User fulfils the order through the conclusion of the purchase process presented on the website www.mnatwalks.com, adding the intended product(s) to the shopping basket.
  • To complete the order the User has to: - Register on the website www.mnatwalks.com by supplying the requested information;
    - Effectuate the “login” (supplying a combination of an email and password chosen by the User on the act of registration);
    - Complete the information and choose the options available throughout the process to complete the contracting of services (address for delivery and receipt, method of payment, as well a Fiscal Identification Number, the name that for fiscal effects should be on the receipt).
  • The final confirmation of the order by the User is equivalent to the full and complete acceptance of the prices and the description of the products for sale as well as the General Conditions of Sale that will be the only ones applied to the concluded contract.
  • The Company will honour the orders received online until the limit of available stocks. In case of lack of availability of the product the Company commits to inform the User as soon as possible.

Article 4 – Payment
  • On the Website www.mnatwalks.com, the Company proposes the following forms of payment via Easypay – Institution of Payment Lda.: - Credit card (Visa, Mastercard);
    - Multibanco reference.
  • In the case of payment with a credit card for orders, the debit will be made immediately to the User’s card after the confirmation of the expedition of the product. If any ordered products are out of stock the value of the products will be credited to the User’s card at the end of the order.
  • In case of payment with credit card for the reservation of activities the debit will made immediately to the User’s card after confirmation.
Article 5 – Delivery/Availability
  • The delivery of the products will made up to 9 working days after the order. The delivery will be made through the company CTT.
  • There will be added to the costs of the order costs of delivery depending on the weight and the country of destination that can vary between 3.35€ and 8.75€ (These values can change according to the distribution company).
  • The availability of the order will be made after the confirmation of payment.
Article 6 – Prices
  • The prices should be considered in Euros, with fees and taxes, taking into account the VAT applied at the time of payment of the order/service.
  • If an increase in price of any product/service is verified the User will be immediately informed given the option to receive the order (making the payment of the difference) or proceeding to its cancelation.
  • For activities there exists special payment conditions for children:
    • - Children under 7 years of age do not pay;
    • - Children with ages between 7 and 12 years pay half price (50%);
    • - Children with ages superior to 12 years pay full price.
Article 7 – Cancelation and Refunds
  • The refund process of order is handled case to case by the Company. The request should be presented in writing to the email contact geral@mnatwalks.com up to 9 days after the order following the refund instructions provided by the Company answered through the same method of contact.
  • The process of cancellation of activities is treated case to case by the Company the request should be presented in writing to the email contact geral@mnatwalks.com:
    - If notified with more than a week in advance 50% of the initial payment will returned;
    - If notified with less than a week in advance the initial payment of will not be returned.
  • Whenever possible the refund should be made via the same form of payment but in case that is not possible the User should present proof of payment and titulary of account or card so that the refund can be made by bank transfer.
  • The Company commits itself to refund the User in the maximum time of 30 days.
  • The products returned must be in the conditions of sale or in the same state that they were when they were delivered to the User without any anomaly or damage.
  • If the amount resulting in the exchange of products of an order be inferior or superior to the initial value, the conditions of adjustment will be indicated by the Company.

Article 8 – Impossibility of Compliance of Activities
If facts that are not imputable to the Company determine the cancellation of the activity, the User may choose to reimburse all amounts paid or change his registration to another equivalent price activity. If the chosen activity is of lower or higher price, the customer will be refunded or must pay the difference, respectively.

Article 9 - Schedules
The User must respect the schedules stipulated for the beginning of the activities as well as the intermediate schedules that are defined by the guide of the same. Delays may imply the impossibility of carrying out part of the activity.

Article 10 - Amendments
In order to ensure greater safety and quality in carrying out the activities, the Company reserves the right to change the time, place and structure of the same if there are meteorological or other conditions, that are not under the company’s control, that oblige us to make the decision.

Article 11 – Degree of Difficulty
It is the responsibility of the User to verify the degree of difficulty of the activity in which he or she is enrolled and if it is adequate to the customer’s capacities. the Company clarifies all doubts and questions during the registration, but cannot be held liable for the fact that the participant does not have the physical conditions or skills to carry out the activity correctly.

Article 12 – Security
  • The Company always has as first priority the safety of all the people involved in our activities, clients, guides or whoever collaborates in the organization of the activity.
  • In guided activities, participants should always follow the guide’s advice to ensure the safety of participants.

Article 13 – Insurance
Insurance policies nº 204190775 and nº 2041907788 of the insurance company Allianz Portugal, S.A. Civil Liability: 50,000.00 Euros, Personal Accidents: Death or Permanent Disability: 20,000.00 Euros, Treatment and Repatriation Expenses: 3 500,00 Euros.

Article 15 – Alternative Consumer Litigation Resolution
Under Law no. 144/2015 of 8 September, the client may, in case of litigation, resort to: GRAAL member company, office for the alternative resolution of disputes. Avenida D. João II, nº 1.08.01 / D / E, Torre H, Piso 1, 1990-097 Lisboa.

Article 16 - Using Pictures and Images
Any User image, taken by the Company guides or collaborators in any of our activities, may be used by the Company in the illustration of promotional and advertising material such as catalogs, slides, videos and the internet. Photos will not be marketed or made available for other purposes where people are clearly identified, without being expressly authorized by the client.

Article 17 – Privacy Policy
The treatment of any data is made according to the legislation concerning to the protection of personal information. The same information subjected to computer treatment with become part of the the Company data base and are intended to the registration and presentation of other products and services as well as institutional information and their availability.
Its usage is option and is guaranteed in terms of law the right of access, rectification and annulment of any data that directly concerns the User, either personally or written, directly to the email on the initial page of this website.
